Terms of Service

1. Acceptance of terms

By booking an audit, subscribing to Banner + Scanner, or otherwise using https://optimalab.io, you agree to these terms. If you do not agree, do not use the site or services.

2. Description of services

• The Audit — a fixed-fee, $1,500 review of trackers, cookies, and vendors on your site, delivered over 1–2 weeks.
• Banner + Scanner — an ongoing monthly subscription providing a consent banner and continuous monitoring.
• Policy Generator — produces a draft cookie/privacy policy section from scan results, intended as a starting point for your own legal review, not a finished, ready-to-publish document.

3. Not legal advice

Our audits, scan results, and generated policy drafts are documentation and tooling, not legal advice or legal representation. Any Data Protection Impact Assessment we produce is reviewed by independent counsel, but that review does not constitute representation of you or your business in an active investigation or lawsuit. You remain responsible for your own compliance decisions and for having final documents reviewed by your own attorney.

4. Payment terms

The audit fee is due at booking unless otherwise agreed in writing. Banner + Scanner subscriptions are billed monthly in advance and can be canceled at any time, effective at the end of the current billing period. Fees already paid are not refunded except where required by law or separately agreed.

5. Acceptable use

You agree not to use our services to scan or monitor a website you do not own or have authorization to assess, or to misrepresent scan results as an official government or legal finding.

6. Intellectual property

Our reports, documentation templates, and site content belong to Optima Lab. Once delivered and paid for, you may use your own audit report and generated policy drafts for your business's compliance purposes.

7. Disclaimers & limitation of liability

Services are provided "as is." To the maximum extent permitted by law, Optima Lab is not liable for indirect, incidental, or consequential damages arising from use of our services, including regulatory fines, penalties, or legal costs incurred by your business.

8. Termination

Either party may terminate a Banner + Scanner subscription at any time. We may suspend or terminate access for use that violates these terms.

9. Governing law

These terms are governed by the laws of [GOVERNING STATE / JURISDICTION], without regard to conflict-of-law principles.

10. Changes to these terms

We may update these terms from time to time. Continued use of our services after a change constitutes acceptance of the updated terms.
